My Emile Zola personna was waiting in the wings, if the undeniable lemonade results did not flow from my "J'Accuse" efforts.
Even with imperious letters of "mandatory", "or else" consequences, I keep receiving lemonade from the lemons of Nebraska State political bureaucracy which takes an adverse position with the workers it should be serving. By the grace of serendipity, I walked into the receptive presence of my Workforce Development Veterans counselor, who not only changed the date from Thanksgiving morning to a more fortuitous Thursday morning for the mandatory orientation, but she signaled and eagerness for my participation in the process.
This was in stark contrast to most of my former encounters, in which Ms. Anne H. of the EEO office and Mr. Art D. were able to have sympathetic and effective (though snail-paced), respectively, results for my grievances and petitions of redress to their agency-being the exceptions to the forthcoming narrative.
A routine application for unemployment benefits revealed identity fraud by a former employer's local staff, who used my social security number to generate ill-gotten, embezzled income from their employer. After three interlocutories, repeating my declarations of events twice to unemployment adjudicators, I still was awaiting my unemployment benefits. I made a complaint at the local IRS office, since a bogus W-2 would be generated by the alleged fraud of the temp agency's employees. It took an email to the chief of the Nebraska Dept. of Labor section to move me past the catch-22 of having an appeal on an item which was irrelevant to my eventual benefit payment, but had created the technicality of a "suspense while in investigation". I learned, incidentally, that my assertion of misfeasance by the employees of that temporary agency was correct, and that the implications by the investigators that I was either hiding the truth or cognitively deficient in my recollection were refuted. The IRS has yet to respond to my complaint-filing to them.
In the meantime I encountered a suspicious practice coming from the computer responses of the Human Resources Department of the University of Nebraska Medical Center. A few weeks before I had applied for a position in their pathology laboratory as an assistant. I had casual knowledge of the process from being a surgery tech who had brought specimens down to the laboratory for dissection and analysis by the pathologist. Though I had not performed the protocols of dissection and analysis, I was familiar with the procedures. After submitting my online application, I received a reply within 30 minutes that stated (paraphrasing) "my qualifications were not the match" they were looking for. Though the response was rapid, I found it credible due to the time-lag. A more recent online application as a customer service agent, for which I had direct skills and experience from the military as an NCOIC manager of three Ear-Nose-Throat clinics over 7-years, was responded to with a similar rejection email BEFORE I could copy and paste the online confirmation window from the application site to my own online archive-less than 2 minutes! After going through the local State Labor Department office, the local EEO rep referred me, after being unable to dissuade me from thinking my cause was unredressable, to the Legal Aid clinic, and the County Bar Referral agency, as well to the Ms. H., the Chief of the Nebraska EEO Agency. The Legal Aid Clinic did not handle job/employment disputes. The county bar association charged $40 for an initial interview visit and the going rate ($100.00+) for subsequent visits. Fortunately, my contact with Ms. Hobbs' office was more and very fruitful. Her receptionist passed on Ms. H. email address, along with the voicemail which I had intended to intercept from my growing skepticism of the grievance process. Ms. H. responded to my email within two hours by calling me. Our conversation was a congruence of thought of the nature of my complaint of the suspicious, too rapid, web site reply, as well as the need for people in my position NOT under the protected classifications of the state and federal EEO laws to have a legislative aid. I had emailed Heath Mello as the "CC:" to my email, and I sent a forward of that email to the Tom White campaign, since Senator White was seeking my financial and personal support for his Congressional campaign through his emailings to me. To this date, I have yet to receive a response from either of those two legislators.
The snail-paced resolution by Mr. Art D. of the Nebraska Dept. of Labor (NDOL) to a wage dispute I alluded gave me the desired, just results. The process allowed my former employer more time to gather information, which I had sought them to acquire two to three months prior by two explicit email solicitations to the manager. The deference given to the employer's claim of ignorance of my situation was irritating in light of the NDOL having being given the relevant dates by me in my initial claim, though I needed to revise my initial claim of days and amount owed, due to a miscount on my part.
These three instances are more than ancedotal reflections on the operatives, but of a broader culture, where the average citizen must jump through hoops, be the suspect of the LACK of the benefit of the doubt, or just be up the creek without any favorable governmental process to protect them from the abuses of the nefarious or the mighty and politically connected. The favorable resolution of the wage complaint, the vindication of my assertion of misfeasance by temp agency employees, and the serendipity of having an advocate as a veterans unemployment counselor for a process that was "imposed" on me arbitrairly and with ambigous, opaque reasons doesnot act as a nullifier for the adverse status I had with the agency's bias towards the employers for political or future economic advantages.
Your three news departments profess to be the "tribunes" of Nebraska Heartland Values. As a born and bread child of the decadent and corrupt East Coast, I had not encountered in my previous 58 years such a close successive run of unethical, illegal, and nonfiduciary pratices as I encountered in seeking redress to honest complaints.

THE NDOL based my unemployment on the 2-4th qtrs of 2008 and the 1st qtr of 2009, leaving the 2nd, and 3rd qtrs of 2009 still in limbo until my allegations about True Blue/Labor Ready are resolved.
The NDOL Labor and Wages guy is awaiting the 7-day overdue response from Centerplate regarding back wages of 2.00/hr covering the period 20 April 2009 through 15 July 2009 (about 54 days; 6hrs per day=$640).
I had an "encounter" with the UNMC HR office. Their computer gave me a rejection notice to my EXTENSIVE job application FASTER than I could cut-and-paste their sites confirmation number for reciept of my application to my online storage archive at notepad.yahoo.com. When I called the EEOC office in Omaha (595-0228 ~or something like that~) I got NO answer after 30 RINGS. I had to call building security to get an alternative number, where I left a message, circa 230pm. AFTER 530pm I get a call back from the person who does her best to try to discourage me from thinking I had less chance than a snowball in hell with the EEOC because the laws circumscribed their purview to protected classes, and there was NOTHING more she could do. After me doing an oral rant, she relents and gives me the Volunteer Lawyer's Project number, along with her bosses 800#. I leave a message with both within minutes of completing the phone call with "Ms. Nothing-I-can-do".
Overnite, I come to the conclusion that a civil suit through the lawyers project would be an exercise in pyrrhic vindictiveness, but find out that they don't handle "hiring practices" cases. They give me the number of the Douglas County Bar Association. Their CSR tells me that IF I get a referral to a lawyer it would be $40 for the first visit, then the going rate ($100^), after-wards.
Also this morning, I called the EEOC Lincoln office to try to intercept a return call to me by their chief, Anne H., since I had plans to handle UNMC more publicly, than deal with another, anticipated, 'nothing-i-can-do' bureaucrat, so not to waste her phone time or more of my patience. Her receptionist volunteers her email address. So I vent an email to her ( with Heath Mello "CC:"ed). Ms H. calls me back with in 2 HOURS (miracle of wonders!!). But she call me "Melvin"-the name of my existential goody-two-shoes "friend" from high school. I grudgingly forgive her, and learn to my pleasant surprise, she agrees with my perception, BUT she needs to have a State senator sponsor a bill before she can do more.
With Heath Mello as my legislator and Tom White barraging my email inbox as the Tribune "vox populi" I have two people whose feet could be put to the fire of public ridicule if they have less than a credible effort or response to this situation.
WHY is it that YOUR WORLD does NOT revolve around MY ISSUES!!!!! GET OVER the HUSKERS being shown to be the champs of the "little pygmie football programs", but the chumps of Div. 1, and obsess yourself ENTIRELY with being the Emile Zola of MY CAUSE.!!

The NDOL-UI has escaped my shit-list. They're releasing my funds w/a dbl-payment expected by mid-week next week for past payments. Appears the decision was coincidentally made circa the time of my last two emails to their chief.
Incase you had some behind the seen or broadcast influence (I like "To the Point" on NPR-sue me!!) that pushed the result, Thanx..
I dropped into the IRS office and gave them an outline on the probable misdeeds of the Farnam & Turner Blvd Office of Labor Ready. That's still a low-hanging fruit story to be picked.
